1. Acceptance of Terms

By completing a purchase, you acknowledge that you have read, understood, and agreed to these Terms in their entirety, including our policies on custom orders, returns, intellectual property, and liability.

2. Service Description

Imaginnd is an AI-powered custom apparel platform. Users create original designs using our AI Design Studio by entering text prompts, and can purchase those designs printed on apparel and accessories. All products are custom made-to-order and produced by third-party print providers on our behalf. We do not hold inventory. Each item is printed and shipped only after an order is placed.

3. Account Registration and Design Credits

3.1 Account Creation

You may be required to create an account to access certain features of the Website, including the AI Design Studio. You must be at least 18 years old to create an account. You agree to provide accurate information and to keep your account credentials secure. You are solely responsible for all activity that occurs under your account.

3.2 Free Design Credits

New users receive a limited number of free design credits upon account creation. Free credits are provided for the purpose of exploring the Design Studio and creating designs for purchase. Free credits have no cash value and are non-transferable.

3.3 Paid Design Credits

Additional design credits may be purchased. The cost of paid design credits will be fully deducted from your cart total at checkout when you purchase a product. Paid credits that are not used toward a purchase are non-refundable.

3.4 Abuse of Credit System

We reserve the right to suspend or terminate accounts that we believe are abusing the credit system, including but not limited to creating multiple accounts, using automated tools to generate designs, or any other activity intended to circumvent the credit system. We monitor sessions and IP addresses to detect and prevent abuse.

4. Custom Products and Order Confirmation

4.1 Made-to-Order Products

All products sold through this Website are custom, made-to-order items. Each product is uniquely produced based on your design and specifications. Because of the custom nature of these products, all sales are final. We do not accept returns, exchanges, or cancellations once an order has been placed and confirmed.

4.2 Order Confirmation

Before completing your purchase, you will be presented with a confirmation screen summarizing your order, including the product, design, size, color, and layout selected. By clicking the confirmation button and proceeding to payment, you acknowledge and agree that:

All sales are final. No returns or exchanges are accepted except for verified manufacturing defects.

4.3 Design Preview Disclaimer

The design previews and mockups displayed on the Website are digital approximations. The final printed product may differ slightly from the on-screen preview due to differences in printing technology, fabric material, color calibration, and display settings. Such variations are not considered defects and are not eligible for refund or replacement.

5. Manufacturing Defect Policy

5.1 What Qualifies as a Manufacturing Defect

A manufacturing defect is an error that occurs during the production or shipping process. Qualifying defects include:

Significant misalignment or incorrect placement of the printed design.

Missing or incomplete print (e.g., portions of the design not printed).

Wrong product shipped (wrong size, wrong color, wrong item entirely).

Physical damage to the product caused during production or shipping (tears, stains, holes).

Clearly defective printing (smearing, bleeding, or peeling upon arrival).

5.2 What Does NOT Qualify as a Defect

The following do not constitute manufacturing defects and are not eligible for refund or replacement:

Dissatisfaction with the design you created or selected.

Minor color variation between the on-screen preview and the printed product.

Ordering the wrong size, color, or layout.

Normal variations inherent to print-on-demand production (e.g., slight differences in fabric texture or print finish between orders).

Products damaged by the customer after delivery.

5.3 Reporting a Defect

You must report any manufacturing defect within 14 days of delivery. To submit a claim, contact us at the email address listed on the Website and include:

A clear description of the defect.

Photographic evidence clearly showing the defect.

We will review your claim and, at our sole discretion, offer either a replacement product or a refund. We reserve the right to deny any claim that does not meet the criteria outlined above or that lacks sufficient photographic evidence.

5.4 Resolution

If we determine that a manufacturing defect has occurred, we will, at our option, either reprint and ship a replacement product at no additional cost, or issue a refund to the original payment method. The resolution method is at our sole discretion. We are not responsible for incidental or consequential damages resulting from a defective product.

6. Pricing, Payment, and Tax

All prices displayed on the Website are in U.S. dollars. Applicable sales tax will be calculated and added at checkout based on your shipping address, in accordance with applicable state and local tax laws. Payment is processed through Stripe. By making a purchase, you agree to Stripe's terms of service in addition to these Terms.

We reserve the right to change product pricing at any time without prior notice. Price changes will not affect orders that have already been placed and confirmed.

7. Shipping

All orders are fulfilled by third-party print providers. Estimated production and shipping times are displayed on the Website but are not guaranteed. We are not responsible for delays caused by the print provider, shipping carrier, customs, weather, or other circumstances beyond our control.

You are responsible for providing a valid and accurate shipping address. We are not responsible for orders that are lost, delayed, or undeliverable due to incorrect address information provided by you.

8. Intellectual Property

8.1 Your Designs

When you use our AI Design Studio to create a design, the design is generated based on your text prompt using third-party AI image generation technology. You are solely responsible for ensuring that any design you create, purchase, or use does not infringe upon the intellectual property rights of any third party, including but not limited to copyrights, trademarks, trade dress, rights of publicity, or any other proprietary rights.

8.2 Prohibited Content

You agree not to use the Design Studio to create, and not to purchase products featuring, designs that:

Infringe upon the copyrights, trademarks, or other intellectual property rights of any third party.

Depict or reference trademarked logos, brand names, or copyrighted characters without authorization.

Contain hateful, threatening, defamatory, or obscene content.

Promote illegal activity, violence, or self-harm.

Contain personally identifiable information of any individual without their consent.

Exploit or endanger minors in any way.

8.3 Watermarking

Design previews generated through the Design Studio are watermarked. Watermarks are removed only upon purchase. Unauthorized removal, reproduction, or distribution of watermarked designs is prohibited.

8.4 Your Responsibility

You represent and warrant that any design you create and purchase through our platform does not infringe the intellectual property or other rights of any third party. You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your breach of this representation.

8.5 Our Rights

We reserve the right to refuse, remove, or cancel any order or design that we believe, in our sole discretion, may infringe the intellectual property rights of a third party, violate these Terms, or contain prohibited content. We are not obligated to review designs before production but reserve the right to do so.
